Juliet was approached by the owner of the property who was seeking advice regarding works to his property in Borough and how to ensure the use was lawful in planning terms.
After reviewing all the available evidence and following a detailed review of case law, Juliet was able to advise that there was sufficient evidence to prove that the use as a single dwelling was lawful in planning terms and therefore was able to provide a strategy moving forward for the client. Juliet prepared and submitted the application for a Certificate of Lawful Existing Use (CLEUD) to Southwark Council, having worked closely with the client to prepare a number of statutory declarations to support the case, with appropriate background evidence. On the basis of declarations supported by Juliet's legal submissions, the council granted consent the Certificate, confirming that the works to amalgamate two flats and the ongoing use of the property as a single dwelling was lawful and therefore immune from enforcement action.
